Reproductive Healthcare and Independent Schools

ISASA received several queries from member schools regarding the provision of contraceptive measures at schools and, in particular, whether schools are permitted, or required, to provide learners who request it with the “morning-after pill”.

On 10 September 2021, ISASA hosted a Girls’ High School Forum at which member schools were invited to consider preliminary guidance on this subject provided by law firm Bowmans. Member schools were afforded an opportunity to raise further questions arising from their context and experience. The attached opinion has been drafted by Bowmans to reflect their preliminary opinion on the legal framework regulating to this matter as well as the further queries raised at the forum.

ISASA is sharing the opinion with the broader ISASA membership for their interest and consideration and to assist with any potential policy-making.
