The Labour Relations Amendment Act, 2014 came into effect on 1 January 2015. A number of provisions in this Amendment Act, most of which become enforceable on 1 April 2015, have implications for independent schools.
The most significant changes that the Amendment Act introduces are extensive restrictions on the use of ‘non-standard’ employees, who are contracted on a fixed-term or part-time basis, as well as labour utilisation through Temporary Employment Services, popularly known as Labour Brokers.
The ISASA Policy Unit has analysed the Act and in the attached memorandum they highlight important issues for the attention of ISASA member schools. They also suggest how schools should best manage their exposure to risk in terms of the new amendments.
